These Marketing and Advertising Terms and Conditions ("Agreement") govern the relationship between Mother Earth Aesthetics, LLC ("we," "us," or "our") and the end user ("you" or "your") who has opted in for marketing, advertising, or has chosen to access our website ("Website"). Please read this Agreement carefully before opting in for marketing and advertising or accessing our Website. By opting in for marketing and advertising or accessing our Website, you agree to be bound by the terms and conditions outlined in this Agreement.

 

1. Opting in for Marketing and Advertising

1.1 By opting in for marketing and advertising, you consent to receive promotional materials, advertisements, newsletters, updates, and other marketing communications from Mother Earth Aesthetics, LLC via email, SMS, telephone, or other communication channels you have provided.

1.2 You acknowledge and agree that the information you provide for marketing and advertising purposes, including personal data, will be processed in accordance with our Privacy Policy. Please refer to our Privacy Policy for more information on how we collect, use, and protect your personal information.

1.3 You have the right to unsubscribe or opt-out of receiving marketing and advertising communications from us at any time. To unsubscribe or opt-out, follow the instructions provided in the communication or contact us directly using the contact information provided in Section 6 of this Agreement.

 

2. Website Access and Usage

2.1 By accessing and using our Website, you agree to comply with all applicable laws and regulations and abide by the terms and conditions outlined in this Agreement.

2.2 You are responsible for maintaining the confidentiality of any account credentials, including usernames and passwords, associated with your access to the Website. You agree to notify us immediately of any unauthorized use or suspected breach of security.

2.3 We may collect and process certain information about your usage of the Website, as outlined in our Privacy Policy. By accessing and using the Website, you consent to the collection, use, and processing of your information in accordance with our Privacy Policy.

4.1 To the extent permitted by law, Mother Earth Aesthetics, LLC shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of our marketing materials, advertisements, or the Website, including but not limited to any losses, damages, or expenses arising from delays, inaccuracies, errors, omissions, or interruptions in the transmission or delivery of such materials or from any unauthorized access or alteration of your personal information.

 

5. Indemnification

5.1 You agree to indemnify and hold Mother Earth Aesthetics, LLC, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or in connection with your use of our marketing materials, advertisements, or the Website, or any violation of this Agreement.

7. Loyalty Rewards

7.1 Earth Points will be rewarded at the time of checkout. Points are non-transferable and cannot be combined with any other discounts, special offers or promotions. Unused points expire yearly on March 31st of the following year,

 

8. Modification of Agreement

8.1 We reserve the right to modify or update this Agreement at any time, without prior notice, by posting the revised Agreement on our Website. Your continued use of our marketing materials, advertisements, or the Website after the posting of any modifications constitutes your acceptance of such modifications.

By providing your consent for marketing and advertising or accessing our Website, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement.

Loyalty Reward Points cannot be redeemed for services or products already on promotional discount. Any orders placed with Loyalty Points for such items will be invoiced at the full price.

PAYMENTS DUE UNDER MEMBERSHIP AGREEMENT

Payment will be processed on the same day of each month as the date the member enrolled into the Membership. I hereby authorize my bank / financial institution / credit card lender to make payments from my checking, savings, debit and/or credit card(s) account on pre authorized drafts and / or charges drawn by (“the Spa”), and post them to my account.

I further acknowledge my payment obligations as set forth in this membership agreement. I, by my signature below and by my payment to the membership and use of the services, confirm my acceptance of all conditions herein. All payments due hereunder will be collected by Electronic Funds Transfer (“EFT”) via a valid debit or credit card which Member shall keep on file with the Spa. I acknowledge all payments will be processed on the first day of each month and it is my responsibility to maintain valid and current card / payment information to the Spa. I agree that my failure to maintain valid and current card / payment information will constitute a default of this Membership Agreement.

 

TERMS OF MEMBERSHIP AND AUTOMATIC RENEWAL

The Membership Term for this Membership Agreement is 3 MONTHS, beginning today following the date on which this Membership Agreement is signed by Member. Unless otherwise cancelled in accordance with the terms of this Membership Agreement, THIS

 

MEMBERSHIP AGREEMENT WILL AUTOMATICALLY RENEW AT THE CONCLUSION OF EACH MEMBERSHIP TERM. If you do not wish for this membership agreement to automatically renew, you must provide written notice of cancellation no less than thirty (30) days prior to end of the then-current Membership Term. All memberships renew at the sole discretion of the "Spa", which reserves the right to cancel this Membership Agreement at any time and to refuse to renew this Membership Agreement with Member.

 

CANCELLATION (more than 3 days after signing)This Membership Agreement may be cancelled by Spa, at any time, at Spa’s sole discretion. In the event of discretionary cancellation by Spa, Spa will refund any payments made by Member for future services not yet provided or which Spa is not yet eligible to receive. This Membership Agreement may be cancelled by Member at any time, by providing written notice of cancellation no less than 30 days prior to the desired cancellation date. No refunds shall be due for any service available or rendered prior to written date of notice of cancellation from Member. If you do not wish for this Membership Agreement to automatically renew, you must provide written notice of cancellation no less than thirty (30) days prior to conclusion of the then-current Membership Term. No refunds are able to be issues on unused months during membership.

 

ACCELERATION OF PAYMENTS:

If you are in default of this Membership Agreement, Spa/Seller can immediately and without notice, demand payment in full of all unpaid installment(s) and applicable fees.

 

DISHONORED INSTRUMENT / DECLINED EFT FEE:

If an automatic debit or electronic funds transfer for the payment of the money drawn on any bank, depository, or credit card submitted by you is not honored or declined, then a fee will be added per the following, in addition to any unpaid balance of this Membership Agreement: (A) A fee of not less than $20.00, which fee is subject to change at Seller’s sole discretion; (B) The amount allowed by state law; or (c) The amount equal to the actual fee imposed by Seller’s payment processing provider as a result of Member’s dishonored instrument or declined EFT.

 

NOTICE

Any holder of this consumer credit agreement is subject to all claims and defenses which Member could assert against Seller. Recovery by Member shall not exceed amounts paid by the Member hereunder.

 

WAIVER AND RELEASE OF LIABILITY

Spa is not responsible for any injury or loss of property suffered by me while receiving Spa treatment(s), participating in Spa activities, or while on the premises of Spa, for any reason whatsoever, whether resulting from the negligence of Spa, its agents, employees, independent contractors, representatives, or guests, members, customers, or any other person or entity.

I affirm that I am of legal age and am freely signing this agreement. I have read this form and fully understand that by signing this, I am giving up legal rights and remedies that I might have now or in the future.

Consumers Right of Cancellation During 3 Days After Signing

You may cancel this contract without any penalty or obligation within 3 business days from the above date, and receive a full refund of all payments made to the seller. You may also cancel this contract if upon a doctor’s order you cannot physically receive the services, or you may cancel the contract if the services cease to be offered as stated in the contract. If you cancel the contract for either of these reasons, the seller, Spa, may keep only a portion of the contract price equal to a pro rata portion of the total price representing the proportion of services you used or completed, plus the cost to the seller of any related goods which you have consumed or retained.

 

***PACKAGES

In order to receive VIP pricing for packages, you must maintain membership for at least 90 days after package purchase. Early cancellation will result in full price of package for remaining sessions. 

 

• Services do not roll over to other months.

• Memberships and product discounts cannot be shared with other persons.
